These Terms of Service ("Terms") govern your access to and use of Getcha System and related services provided by Getcha Solutions ("we", "us", "our").
By accessing or using the Services, you agree to be bound by these Terms.
1. The Services
Getcha System is a software platform that may include modules and features such as client management, bookings, dashboards, CRM tools, workflow tools and related business functions.
Certain features may be available free of charge up to certain limits, while other features may require payment.
2. Eligibility and Authority
You must use the Services only if you are legally able to enter into a binding agreement.
If you use the Services on behalf of a business or organisation, you represent that you have authority to bind that business or organisation to these Terms.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities carried out under your account.
You must provide accurate and up-to-date information and promptly update it if it changes.
4. Subscription, Billing and Payment
Some parts of the Services are provided on a subscription or paid basis.
By subscribing, you agree to pay all applicable fees, charges and taxes.
Recurring subscriptions may renew automatically unless cancelled before the next billing date.
Payments may be processed by third-party payment providers.
5. Free Features and Limits
We may offer free access to certain modules or limited usage tiers. We may modify, suspend or discontinue free features, usage limits or eligibility criteria at any time.
6. Acceptable Use
You must use the Services only for lawful purposes and in accordance with our Acceptable Use Policy.
You must not misuse the Services, interfere with their operation, attempt unauthorised access, or use them to store or transmit unlawful, harmful or infringing content.
7. Customer Data
You retain responsibility for the legality, accuracy and integrity of the data you or your users submit to the Services.
You represent that you have all rights, permissions and legal bases necessary to upload, use and process such data through the Services.
8. Intellectual Property
We and our licensors own all rights, title and interest in and to the Services, including software, design, text, branding, graphics, interfaces and related intellectual property, except for Customer Data.
We grant you a limited, non-exclusive, non-transferable, revocable right to use the Services during the applicable subscription term, subject to these Terms.
9. Availability and Changes
We aim to keep the Services available and functional, but we do not guarantee uninterrupted, error-free or always-available service.
We may modify, update, suspend or discontinue any part of the Services at any time.
10. Third-Party Services
The Services may integrate with or depend on third-party tools, platforms or providers. We are not responsible for third-party services or their availability, accuracy or security.
11. Suspension and Termination
We may suspend or terminate your access to the Services if:
- you breach these Terms
- you fail to pay applicable fees
- your use creates risk, harm or legal exposure
- we are required to do so by law
You may stop using the Services or cancel your subscription at any time, subject to any applicable billing terms.
12. Disclaimers
The Services are provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, we disclaim warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title and non-infringement.
13. Limitation of Liability
To the fullest extent permitted by law, Getcha Solutions shall not be liable for any indirect, incidental, special, exemplary, consequential or punitive damages, or for any loss of profits, revenue, business, goodwill, data or opportunities.
Our total aggregate liability arising out of or relating to the Services shall not exceed the amount paid by you to us for the Services during the three (3) months immediately preceding the event giving rise to the claim.
14. Indemnity
You agree to indemnify and hold harmless Getcha Solutions and its personnel from claims, liabilities, losses, damages and expenses arising from your use of the Services, your Customer Data, or your breach of these Terms.
15. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after updated Terms are posted constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of Singapore.
